VARAKTerms of Use
These terms are an agreement between you and Erdal Beyoğlu, the developer of VARAK: PDF Editor. By downloading, installing or using the app you accept them. If you do not accept them, do not use the app.
1. Parties and definitions
"VARAK" or "the app" means the VARAK PDF: Editor, Sign & OCR application for macOS, iPadOS and iOS, including any updates, and all documentation, artwork and content that ships with it. "Pro" means the optional non-consumable in-app purchase named VARAK PDF Pro. "The developer", "I" or "me" means Erdal Beyoğlu, an individual developer. "You" means the person or entity using the app.
2. Licence
Subject to these terms, the developer grants you a personal, non-exclusive, non-transferable, revocable licence to install and use VARAK on Mac computers that you own or control and that are signed in to your Apple Account, in accordance with the usage rules in Apple's Media Services Terms and Conditions. The app is licensed, not sold.
You may not copy (except as permitted by Apple's usage rules), modify, adapt, translate, reverse engineer, decompile, disassemble or create derivative works of the app; remove or alter any proprietary notice; rent, lease, lend, sell, sublicense or redistribute the app; or use the app to build a competing product. Nothing in this section restricts rights you have under applicable law that cannot be waived by agreement.
3. Free features and the Pro purchase
VARAK is free to download and use. The free tier includes reading, searching, annotating, filling and saving forms, hand-drawn signatures, page organisation, comparison and Document Health, with no time limit and no watermark. The developer may change the exact boundary between free and Pro in future versions, but will not remove from the free tier anything you have already used to create content in a file.
Pro is a single non-consumable in-app purchase (product identifier com.varak.pdf.pro) at a one-time price displayed in the App Store in your local currency, US $19.99 at the time of writing. It is not a subscription, does not renew, and carries no recurring charge. Once purchased, Pro is available on every Mac, iPad and iPhone signed in to the same Apple Account; use Restore Purchase in the app to re-enable it on a new or reinstalled device. An optional free 3-day trial of Pro is offered as a separate $0 in-app purchase (com.varak.pdf.trial3day); it starts only when you choose it, and nothing is charged when it ends. Pro is bound to your Apple Account, not to a device.
Prices may change for future purchasers. A change never affects a purchase already made.
4. Apple and the App Store
VARAK is distributed exclusively through the App Store. Your purchase of Pro is a transaction with Apple, subject to Apple's terms. Apple, not the developer, processes payment, issues receipts and decides refunds; refund requests must be made to Apple through reportaproblem.apple.com. The developer has no access to your payment details and no ability to issue a refund directly.
You acknowledge that these terms are between you and the developer only, not Apple; that Apple has no obligation to furnish maintenance or support for the app; that Apple is not responsible for addressing any claim relating to the app, including product liability, legal or regulatory compliance and consumer protection claims; and that Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. In the event of any failure of the app to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app.
You represent that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
5. Your documents and your responsibility
VARAK operates on files you choose to open. You retain all rights to your documents. The app never transmits them anywhere (see the Privacy Policy). You are solely responsible for:
- having the right to open, edit, sign, redact, convert or distribute any document you process with the app;
- keeping backups. VARAK verifies every save before it replaces your file and refuses to write a result that would not open correctly, but no software is infallible and a backup is the only real protection against loss;
- reviewing the output of every operation before relying on it, including edited text, filled forms, converted spreadsheets and documents, recognised (OCR) text, and redacted files;
- the legal, contractual or evidential consequences of any document you create, alter, sign or send.
Text recognition, conversion and comparison are automated processes that can and do make mistakes, particularly on poor scans, unusual fonts and complex layouts. They are aids, not certifications.
6. Redaction, signatures and security features
Redaction. VARAK's redaction removes the content beneath a redaction mark from the file. It does not, and cannot, remove information you did not mark, information embedded in ways the app does not analyse (for example inside attachments, certain metadata, or images of text that have not been recognised), or copies of the document that exist elsewhere. Before sharing any redacted document you must verify for yourself that everything you intended to remove is gone. The developer accepts no responsibility for disclosure resulting from incomplete redaction.
Personal-data detection. "Find personal data" uses pattern matching to suggest IBANs, card numbers, identity numbers, e-mail addresses and phone numbers. It will miss some and mis-identify others. It is a convenience, not a compliance tool.
Digital signatures. Certificate-based signing uses a certificate you supply. The legal effect of an electronic signature depends on the certificate, its issuer and the law that applies to you and to the document; VARAK makes no representation that a signature it produces is valid or enforceable in any jurisdiction or for any purpose. VARAK does not support hardware-token (e-imza / PKCS#11) signing.
Passwords. If you protect a file with a password and forget it, the developer cannot recover it. Password removal works only on files whose password you know or that carry no owner restrictions you are not entitled to lift; do not use it on documents you have no right to open.
7. Acceptable use
You agree not to use VARAK to infringe anyone's rights, to forge, falsify or fraudulently alter any document, to remove copyright notices or digital-rights information from works you do not own, to circumvent access controls on documents you are not authorised to open, or in any way that breaks the law where you are.
8. Intellectual property
The app, its code, design, icon, name and documentation are the property of Erdal Beyoğlu and are protected by copyright and other intellectual-property laws. "VARAK" and the VARAK icon are used as trademarks of the developer. The app incorporates open-source components under their own permissive licences; their notices are reproduced in the app's acknowledgements and their licences govern those components. Mac, macOS, iPad, iPadOS, iPhone, iOS and App Store are trademarks of Apple Inc.; Adobe and Acrobat are trademarks of Adobe Inc.; Microsoft, Word and Excel are trademarks of Microsoft Corporation. None of them endorses VARAK.
Feedback you send about the app may be used to improve it without obligation to you.
9. No warranty
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VARAK IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. THE DEVELOPER EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT AND QUIET ENJOYMENT, AND ANY WARRANTY THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT DEFECTS WILL BE CORRECTED. NO ADVICE OR INFORMATION, WRITTEN OR ORAL, OBTAINED FROM THE DEVELOPER OR THROUGH THE APP OR THIS WEBSITE CREATES ANY WARRANTY.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you; in that case any implied warranty is limited to the shortest period and the smallest scope the law allows.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, LOSS OF DOCUMENTS, CORRUPTION OF FILES, LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL OR ANTICIPATED SAVINGS, OR FOR ANY DISCLOSURE OF INFORMATION RESULTING FROM INCOMPLETE REDACTION, OR FOR THE INVALIDITY OR UNENFORCEABILITY OF ANY SIGNATURE OR DOCUMENT, ARISING OUT OF OR IN CONNECTION WITH THE APP OR THESE TERMS, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THE DEVELOPER'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRO PURCHASE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR TEN US DOLLARS (US $10), WHICHEVER IS GREATER.
Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including for death or personal injury caused by negligence, or for fraud. Where consumer-protection law in your country grants you rights these terms cannot override, those rights prevail to that extent.
11. Indemnity
You agree to defend, indemnify and hold harmless the developer from any claim, damage, loss or expense (including reasonable legal fees) arising from your use of the app, your documents, your breach of these terms, or your violation of any law or the rights of any third party.
12. Updates, changes and discontinuation
The developer may release updates that add, change or remove features, and may modify these terms; the current version is always at varak.app/terms.html with its effective date. Continued use after a change means acceptance of the changed terms. The developer may discontinue the app or stop supporting particular operating-system versions at any time. Because there is no server component, a copy of the app you have already installed will keep working for as long as your operating system runs it; no online check is required for the app or for Pro.
13. Termination
This licence ends automatically if you breach these terms. On termination you must stop using the app and delete all copies. Sections 5, 6 and 8 through 15 survive termination.
14. Governing law and disputes
These terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. The courts and enforcement offices of Istanbul (Çağlayan) have jurisdiction over any dispute, without prejudice to any mandatory consumer-protection rules of the country where you habitually reside that give you the right to bring proceedings there. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Before starting any proceedings, please write to the developer; almost every problem can be solved with an e-mail.
15. General
These terms, together with the Privacy Policy and Apple's applicable terms, are the entire agreement between you and the developer regarding the app. If any provision is found unenforceable, it will be enforced to the maximum extent permitted and the rest remains in effect. The developer's failure to enforce a right is not a waiver of it. You may not assign these terms; the developer may assign them to a successor of the app. Headings are for convenience only. In case of conflict between translations, the English text prevails.
